Re: wage ceiling increasesd under payment of wages Act
Dear Anil Kaushik,

Thank you for sharing the information.

Infact i happen to read the same and while discussing with my colleague Head of Finance - he pointed out that nowhere in the notification it is mentioned that it is applicable on ESI.

Request you to enlighten us please!.

Also, how should be deal with the situation for the deductions made prior to the notification and deposited with ESI accounts. Here the company is larger contributor with 4.75 % compared to employee's share of 1.75%. Can we ask for the recovery?

Thanks,

Rajat Joshi

Re: wage ceiling increasesd under payment of wages Act
Dear rajat,
this enhancement of wage limit under payment of wages act has nothing to do with ESI or PF or GRATUITYor BONUS.
The object of the payment of wages act is to reulate the payment to employees from employer, which means that employer is under obligation to pay salary or earned wages latest by 7th of each month for the preceeding month with certain legally permissible deductions. now if employer does not pay the salary or deduct some amount from wages/ salary which is not permissible, from where employee seek s the relief ?
and also which category of employee can take protection under this act against employer for his illegal actions?
the act answers these questions.
now any employee who draws 10000/ or less can seek relief uner this act and can apprach labour authorities. Earlier employees drawing up to 1600/ were elligible to seek relief which ultimately enhanced to 6500/ and now made Rs. 10000/
ESI deductions are permissible under the act and this amendment nowhere implies that employer has to deduct esi on 10000 for each employee.
hope the issue is clear.
u are welcome to have telecon with me on the issue if so desire.
