Dear Sir
Company has initiated civil case against me. The court summon has not reached me as company has given them my old address(though they knew that I left the place years ago and all the communication is done from/to my new address). I want to know how many efforts a court makes to deliver summons. Also till the summon will not come in my hands what should I do. Do I go straight away to court and ask for it or should I wait it to reach my new address. Will any delay from my side takes the things against me. As per my understanding in civil suits, till the summon is not effectively delivered the case won't proceed. Please help me by clarifying these doubts.

Go to court and inform the address change or receive the same in person. Otherwise, the case will be decided ex-parte. Pon

In the labor office you can get the copy. Either go the court directly and collect in person, or if know authority in labor office seek help from them.

Hello,

You have not written how came to know that a civil suit has been filed against you by the Company. What are the contents of Suit. What is your defense against the allegations. If you feel that the charges are serious and if decided ex-parte will harm you, then you must approach the Hon'ble Court through your legal adviser and request for copy of Suit papers. If there is any IPC No. which warrants your arrest, you should request the Court for anticipatory bail. The plea that you did not receive the summon will not be much helpful as because, if decided Ex-parte, how can you come to know the outcome. If you have some associates in the Company, they will also not be of much help once the case is decided. It is your duty to inform your latest address to the Company, till you have not been relieved by the Company in writing and all the dues/receipts have been cleared by both i.e. by you and the Company, and the Company has issued a "No Dues" certificate in your favour.
