I m working one of the MNC co. which is situated at Navi Mumbai..

In Aug. month there is lot of work load is on all employees of data entry, Our HR told that stay at night & complete the work if you not stay we will make NC against you n you will laible to pay penalty amt i.e. rs. 10000/- but one of the emplyoee told that he cant stay at night will come on next day (next day is holiday) bt co. not agree this condition & the lock off. outside & keep up in off. in morning that employee make NC against Co. & the Police came off. & warn our boss.. & told them to pay His salary.

In next day sir admited his secretary in hospital (she is 5 month pregnant) & make NC against that employee that because of him my secretary BP goes high & she is admitted in hosp.

& also make FIR on that police hawaldar also that they. and also write letter to labour commissioner a false misgaration.

so police arrested that employee & also suspended that hawaldar for 15 days also.....

If a person make false FIR & loyal person will go to Jail then what kind of law will save him to face this problem..

Pls tell me in future what kind of precaution will have to take

To be honest, these kind of situations create a big problem. If the employee is very upset, he might even kill the HR. Strict action must be taken against that HR.

Dear Gitmane,
Since one of the employee is arrested, first and foremost try to obtain bail for him. Secondly, pass on the information to news media like ABP Majha. However, keep your identity secret. Hunger of news channel is insatiable. They will do the further needful.
For Bugmenot2: - More than HR, it is leadership's problem. HR could be puppet at the hand of leadership in such companies.

This is a very typical situation where answers cannot be given in a simple manner. The situation so explained is certainly alarming. Let me explain first that no person can be detained or fortified except having a legal authority. The Employer has certainly no legal authority to detain any employee for any reason. This is a criminal offence and certainly FIR can be lodged against the person who does so.

I think the approach of HR Officer was certainly totally incorrect and disgusting. The last moment communication and giving threats do suggest that the production department was certainly lacking their home work. When there is a heavy workload, it could have been planned well in advance.

Giving threats that a police complaint will be filed against the employees if they leave the place is simply childish. There cannot be any police complaint for this reason.

I will certainly advice that to avoid such situations, it is always better to place your grievances collectively to the higher authorities. Let you all make a post-mortem of the incidence occurred in August 2013 without fail. In discussions submit the points and problems you face and ask for proper directions preferably in writing from higher authorities. Please do not ignore such incidences but seek firm directions from higher authorities.
