Hi i want to take an opinion of you guys on the following for my friend she has got an offer from an it firm for joining as a recruiter but tells that she would have to sign a bond of 2 years .and also apart from signing a bond she has to give a cheque without date of rs.2.5 lakh as a security with the bond if she leaves the company before 2 years that cheque will be encashed otherwise it will be returned to her after completing 2 years. i have heard before that companies sign the bond and asks to pay the amount if an employee wants to leave before 2 years but is this a new thing in this industry that they ask for a cheque in luie of the security. i mean what is the use of the bond then if they are asking for the cheque. they might even misue it so what should she doany idea as to the cheque should be given or only a bond should be signed.

Employment bond with blank unsigned cheque
I have given a blank cheque and an agreement for employment for 1 year. but i didn t signed the cheque. now he is saying that he will default the cheque. is it possible

In the year 2014 i was working with an indian it company as sales executive where i signed a employment bond for 1.5 years against which company took a blank cheque. after 6 months only due to some family issue i left the company by just sending an email to hr. since i broke the bond company deposited my blank cheque with the amount of 2.4 lakhs and due to account closed the cheque got bounced hence lawyer started sending me demand notice for which i gave no response then company filed section 138 cheque bounce case against me. i lost the case in district court and judge said that i did not submitted email copy to court hence i am convicted and have to pay 3.5 lakhs defaulted then 6 months jail. now i have applied in session court and matter is under session court. due to poor knowledge and poor lawyer i lost the case but now i want to know possible ways to finish this case.

Hi members i would like to know 1. what is the legality of the employment bonds which the employees sign with the employers against some training programs? 2. getting any bond from employee is legally enforceable or not? i have gone through all the post related to service bond but was not able to find single satisfactory answer as it doesnt refer to any act law or rule. so i request you to provide legal view and not personal understanding about this matter.
