Dear Seniors,
I would like to seek your openion on the following:
Ours is an Engineering Industry situated in Bommasandra Industrial area. Our Management has shifted to 5 day woking due to marketing/production constraints and this will be in force for two and three months.
Shift timings due to shifting over to Five day week:
First Shift: 5.30 hrs to 15 hrs – including lunch break for 0.30 minutes.
Second Shift: 15 hrs to 24 hrs (12 mid night) – including lunch break for 0.30 minutes.
General Shift : 6 hrs to 18 hrs _ This timings we have made especially for the Moulding area to have better energy saving and production.
This is including lunch break for 0.30 hrs. – Four day week – From Monday to Thursday.
And again 18 hrs to 6 hrs - do – - Four day week – From Tuesday to Friday.
Kindly post your openion whether this is ok and can we give intimation to Director of Factories and Labour Commissioner.

Dear Paul
The Factories Act rules are framed on the basis of normal work condition with 8 hours work with half an hour break. Any change made in this should be informed and have the approval. Therefore you can contact your Factory Inspector to proceed further. Normally your propossed working hours will not be allowed despite the fiveday week system. Decide accordingly dependiing upon the situation.

Hi Paul,
I completely agree with Mr.Ragavendiran. As per the Factory Act rules, the normal work condition should be 8 hours with half an hour of break. Since your company has decided to change the shift timings, the management should intimate the Factory Inspector and get his approval before implementing the same.

An employee is allowed to work for 9 hours in a day. as per section 54 of Factories Act 1948.There is no exemption provision for extending working hours. Beyond 9 hours working in a day will be treated extra hours attracting OT hours provisons under section 59.
However, section 51 allows 48 hours as weekly hours of working.Beyond 48 hours in week will be liable for OT under section 59 again.
Becareful any violation will lead to prosecution of Occupier and Manager.

Dear Gopaul
Already Mr. Ragavendiran and Mr.Mritunjay Nath Sahu has given you the reply.
1. The Five days work will be accepted by Inspector of Factories of your state and you will get approval but for 4 days 12 hours work approval is not possible. If they accept also you must pay Double the OT for 12 hours period. So reconsider and act accordingly.
2. Before commencement of changes in the working hours, please obtain the approval from the Factories Inspector as yours is a manufacturing industry.
