As per your appointment letter, one month notice is required to terminate or to resign, no further explaination is required. Please refer your appointment letter first.

Dear Sumitji,
Kindly refer to your appointment letter, in which clause for the termination of employment by either side must have been mentioned. In the absence of appointment letter, standing order or model standing order will be applied

Dear Sumit,
Greetings of the day!
You are passing from the stressful situation, do not panic this is not an end to your career.
I believe you played a supervisor role in your organization. Employer terminate your service may be your service is no more required by them or your skill doesn’t match with the profile any more or anything may be.
I would request you to refer your employment contract for notice period ask them for gratuity, leave bonus along with your notice pay to your employer during your F&F.
Most important thing discuss with them during exit process the reason for separation, but do not plea them for job and deal them with your dignity. This may help you to know and improve yourself.

Build confidence on you and start again there is better than this in your future.

Dear Sumit,
Apart from the clause which is mentioned in the appointment letter, are you the only person who is terminated from the services or are there some more? Do not plea for the reason, rather you shall speak with your immediate supervisor/manager asking for a reason behind the termination. Termination is carried out for many reason, please try to find out by speaking with the concern person. Until then what ever comments/suggestions given, would be of no use.

Dear Mr Abedeen,
Thanks for your suggestion
I am not panic and not worried about termination as you mentioned in your post that they can terminate me due to performance but i asked to my boss and director that why college is terminating me and they said we don't have any reason for this and they clearly said that your performance is very good but college don't required your service. I don't know the HR rules so can you please tell me what can i do now and what action i can take against my termination.
i am not asking for job or to revoked my termination, i want to know the reason and justification of my termination.

Sumit Kumar

They have mentioned in my termination letter that they are terminating in para number 5 and para number 5 is Services can be stopped either side by giving one month notice/salary but they have mentioned that if faculty can't leave college in mid semester and if faculty want to leave in mid semester they have to pay remaining semester salary to college, college terminated me at the starting (but classes not started yet).
In this condition what can i do please help me in this metter

Sumit

Dear sumit kumar.

I Appreciate your persistence in knowing the H.R Rules in this issue.

From the statements of you, it is presumed that you can challenge this issue through court of law if it is worth fighting taking into account of your salary ,retirement benefits and your career development in that institution .If it is an golden egg you can seek the help of an advocate. Otherwise seek for a better job.

The reason behind is

No person can be stopped from service merely giving one month notice unless otherwise it is mentioned in the appointment order. That too can be done before conformation of your service. If your services have been confirmed with an written order and probation declared with time scale of pay it is a challenge able case under conferment act.,Which says that if a person has worked for 240 days with in a continuous period of one year or 480 days with in a continuous period of 2 years he is eligible for permanent status and his services are deemed to have been confirmed. So in that case your termination should have been assigned with proper reason . It is presumed that to give the job to some one else you have been taken to immoral punishment. So you can file a suit either for reinstatement om.r for compensation in the appropriate forum.

All the best.
