Hi ,
i wanted to know what are the requirements for a start up to have in place in terms of labor laws. If a company is labor driven, what are the requirements to be followed probably in terms of compensation, PF, leaves, and if there is any other thing.

Your query is not specific to any particular subject. Labour Laws and its application is very vast subject. There are many labour laws governing to wages, social securities, welfare, industrial relations & cess. Application of each law is depends upon various parameters. It is a subject to study.

There are certain labour laws which you need to follow for a start up co.

1. If it is a mfg co. you need to apply for a factories licence in the prescribed format alongwith the necessary documents.If it is not a mfg activity, then shop act licence applicable.

2, Thereafter you have to survey the surrounding cos with similar turnover and activity to bring parity in wages so that you dont pay less or more on that account.

3. In this regard, you need to follow the Minimum wages act as per the schedule applicable to your activity. You have to add the special allowance declared by the Govt. of Mah. every six months

4. In case you engage more than 50 workmen, you are liable to pay the min. hra as per Mah.Minimum HRA act which is 5% of basic plus DA.

5. You have to give the notice of opening under Payment of Gratuity act to the concerned authority.

6. In case you plan to engage contract labour for allied activity, then registration under contract labour act is contemplated if they exceed 20 in no.

7. If ESI and PF are applicable, then you have to apply for code no.

These are the initial formalities, other labour laws to be followed such as Mah.labour welfare fund etc.
