Dear all seniors,
One very important question.
If a company has a license of PF but that company is only deducting the PF of only 20% employees.
now 2nd thing they haven't filled up the form 11 of any other employees at the time f joining or ever..
now please tell me if i want to save this company from the audit of PF, what I need to do ?
Please help me out to solve this problem.

Dear Vipul,
One way out for this is that you can get form 2 filled in now from all employees and submit the same.In my experience one of my past employers had also not filled in form 2 at the time of joining of employees which was highlighted in internal audit.Then we got the same filled in and submitted it mto PF office.
So now you can go ahead, fill up the PF forms (FORM 2 --Nomination for PF ) and submit the same to PF office.You wont land up in a problem.

Now I would like to ask you for Form 11 as I mention in my question.
what should I do for that ?
And Form 2 Should be maintained by me or i have to submit it in PF office ?
Is it compulsory to submit there ?

Dear Vipul,
Regarding form 11 you can get the same filled up now from the employees for all those employees who dont want their PF to be deducted from salary. Take their signatures on the form and maintain the same in your company records. Form 11 is not to be submitted in PF office.So get form 11 filled in, signed and retain them in your office records.
In case of Form 2 you need to get 2 nos of form 2 filled in by the employee at the time of joining and 1 of the same is submitted to PF office and the other will be the acknowledgement copy from PF ofice for receipt of form 2. Yes it is compulsory to submit form 2 in PF office and retain its acknowledgement with you for company records.

So it is clear that copy of form 11 will be stay with me so it is not required to submit in PF Department and Only form 2 we have to submit in 2 copy. right ? but they will not ask that why you are late ? and why you have not submitted at the time of joining. will there be any issue with that ?

Dear Vipul, Thats right.As far as form 2 is concerned there wont be any issue for late submission as it is meant for nomination so dont worry you can submit form 2 now.

Dear Vishal, I have tried my best to get this information. As per the information I got is indicate that now Form 2 submission is online so what about that OC copy ?
