My under probation friend start last Nov 21 2012 but he submit his resignation letter April 27 2013 . H was advised by his employer to work until May 27 2013 and work even it is within the one month notice period as required by company . Last salary received was last April 25 2013 .
In offer letter it is said under probation employee terminated or do not complete probation period will pay for the expense incurred by company for processing of working visa and others .
Probation Period is 6 months . Did he achieve the 6 months period , on the said dates or not .
Do the company will pay him after working within his one month notice period , April to May .

Last Working date: 27 May 2013
Total working Days: 6month 6 days.
This mean before the end of probabtion the employee resigned, thereby terminating the contract and attracting the "Penalty Clause".
Now as per Qatar Labor act, the employee must be paid for all the days he worked. But, the employer, as per the contract, has the right to deduct from his full and final settlement the dues as agreed upon.

Dear Inna3a,
As per the Joining and Resignation date, your friend has tenured for 5 months 6 days. Usually the probation was for 6 months; as per the instructions of the management your friend has worked for the (1 more month) probation completing 6 months 6 days. There is ain't no rule in the books mentioned that your friend shouldn't resign while in probation -- No penality is levied in due resignation.
The company will pay for the total amount of working days worked by the employee. Do ask your friend to pull off the exit formalities along with the F&F by the employer.

We appreciate your reply and thank you for sharing . Any idea of how many days does it take for him to stay here in Qatar while the company HR is processing his documents in able for him to exit Qatar.

Any idea of how much the company will deduct for said dues and of how many days will my friend be able to stay here in Qatar while his waiting for a call or email from the company HR processing his documents to exit Qatar.
How long will he be banned in Qatar.

Answering two question to me and Sharmila Das.

1. Employee would have have to stay in Kingdom till the sponsor puts "Only Exit Stamp" on his passport. Usually after the exit stamp is stamped you can immediate leave if you have your travel ticket ready.

Also, Qatar Labor say, "an employee under sponsorship is not allowed to leave the country, without No Objection Certificate from the employer. Without the release letter from the employer, the employee will be banned for two years from entering Qatar." So, please maintain atmost reasonable relationship with the sponsor and leave in peace. I know it sounds weird, but thats how its works in Middle East particularly in Qatar, Saudi and Kuwait. If you have had a bad relationship with the Employer, he may "Ban you for lif"e from working in Qatar, by reporting against you while giving you "Exit". Wish you all good luck.

Incase, you have to book you own ticket, please do it only after you witness your "only Exit" on your passport.
