Greetings...
Recently I have joined one good service industry and this is in existence from April-2011 (As per Shop Act license ) and showing 16 employees were working at that time. Till date employees number goes near about 74 in April-2013.
As per PF & ESI Act it should make registration but due to some technical problem registration have not made yet. So in this case how I shall process for PF and ESI registration without any issue and other compliance? We have fill employees Form NO-11 for PF not contribution while joining with employees consent.
Management do not wanted to increase cost but ready to make all contributions May-2013 onwards on same.
In any how I wanted to make PF & ESI registration without any big problems....
So, please appraise me on same with your precious opinion, experience and value ASPA.

You register your company in to PF with the Date of Form 11 registration (that may be May-2013). you issue the Appointment letter to your 74 employees form that date only. for this you have to manage your 74 employees and the PF inspection Authorities.

in the ESIC case if u got AP shops & establishment Licence number then u can register Your company online form your company desired may-2013 date. same the ESIC also u have to issue means you have to show all employees are jointed this date only.(at inspections only if happen generally it happen they may ask employees too)

If u convinced your employees that from this date we are providing these facilities to you so we are giving the revised appointment letters then they may get convince and they may support you. (by saying yes i join on May 2013)

this is one way

another way was costly way from the date of employees coverage increased you have to pay all payments and penalties.

but u can go with the first way generally you won't get caught because of huge number of firm and limited PF & ESI Inspectors.

Well I second Mr Ramnarayan, if you do not have registration of EPF & ESIC, you must obtain first and for this, you can visit to your nearest EPFO and ESIC Office if facing any kind of problem in registration. But could you share what are the problem /technical problem/issues that you are facing while registration?

As suggested by your senior, you can register your employees under ESI Act with effect from any date u wish. But how are you going to manage in the future. Social Security Officer\'s duty is to report what is payable, from when it is payable and what is paid and what is the balance payable. For this the SSO (Social Security Officer of ESIC) shall demand for production of Books of Accounts for the last 60 months and the Final Accounts together with the IT returns, for verification. Your Books of Accounts shall always speak from which date your establishment was to be registered and the amounts of your dues etc. Better you register from which date it was actually due to be. 99.9% of our SSOs shall never be ready to get carried away by the false statements of your employees, as their reports are always subject to Test Inspection and vigilance inspections. Thanks for your valuable advice....
I would like to go as per ur first opinion. I will show to PF authority as we are started new organization with such kind of employees...
I have some question in mind as below...
1) If inspectore ask to produce recored then we can show him from APril-2013 onwards. In case if on suo moto he make cross inquiry then we can get caught or not....
2) if PF officer ask me any question on same then what whoud my defence...
3) is PF inspectore ask to all past docs on smae?
4) if he reveal that we are going to opt number with fake docs, then what would be consequences?
Other need to be taken into consideration....
plz share me all your worthfull opinion.
