in case of employee was absent from last 5 years for medical problem. now he decided to take resign. so gratuity calculate in absent period or not? pl advise

One Employee joined in Jan.18 & worked only 10Days. He met an accident in factory premises after 10 days from his Date of Join. The factory situated in Chattisghat. He was covered under EPF & ESI. What type of death Benefits for his family & what type of forms will required under verious Labour Laws. Pls send the particulars

Dear Mr. Daulath,
If the employee has atleast one contribution to EPF , his family is eligible for Family pension. If you had initiated the process of epf registration for this employee pay january EPF contribution, you are saying he is a member of EPF so I presume he has contributed EPF for January/ or he was a member before joining your company. His family will also be entitled for EDLI (employee deposit linked insurance) , the minimum pay out has been increased to 2.5lakh WEF 15/02/2018, probably may not be available in his case but as per old entitlement also 24 times average salary( Calculated as average of last 12 months). Minimum pension is Rs 1000 as on today ( there are some reports of this being revised to Rs7500). Of course accumulations in EPF also will go to nominee/ legal heir.
For claiming all the three benefits EPFO has now introduced a composite application form copy of which is attached.
Under ESIC also there are similar benefits available, but I don't know whether one can avail both. I think Funeral expenses which is Rs 10000 cane be availed. I don't know whether pension is available under ESIC, so it will be advisable to go for EPF benefits in view of Pension entitlement & likely hood of minimum pension being revised to Rs 7500/ I suggest you study benefits under both EPF & ESIC & decide.

Dear Mr Janardhan,
Thank you for the beautiful XL where benefits under various schemes are listed. Can one avail benefits of ESIC & EPF? How is pension calculated in case of ESIC ? In EPF it is roughly EPF salary (average salary of previous 60 months) X pensionable years (No of years contributed to EPF) all divided by 70. In death case even one month contribution to EPF makes dependents eligible for pension, no requirement of 10 years service applicable to normal cases. Widow gets this amount & children up to 2nos of upto 25 years age gets 25 % each of this amount, now the minimum pension is Rs 1000 , which is reported to go to Rs 7500/
If both ESIC benefits & EPF benefits can not be availed, which one will be more beneficial? In this forum I have replied to a gentle man who put a query as to what are entitlements to a person who died in an accident while working.Pl. see that also before replying
