Dear esteemed members i have seen small pvt. co. wherein hardly 4 or 5 women employees working gets fired whenever they disclosed about their pregnancy to employer. the employer dismisses the employee stating the reasons that employee now working efficiently but the main is they are not interested in paying maternity benefits hence treat it as cost rather then right of an women employee. in such situation what should a women.... if i m not wrong the law prevents a women on maternity leave to get terminated but here its a different case as the women is still working.

Hi sr i have a querys related to maternity leave. pls reply keeping legal as well general hr practices in mind: 1. the salary company is liable to pay during maternity leave is of total salary or basic salary only? 2. how a company can assure that women will rejoin after maternity leave period is over and not resign. i mean is there is any way out that company can assure that women will return to work after the break and not continue. can we pay her maternity breaks dues after her rejoining the duty? i am asking this question because one of our employees went on maternity leave and she was suppos eto join back on 15 may but when she joined back she resigned the next day saying she is finding it difficult to manage and may go for longer break after getting relived from the company? pls give your comments on what company should do in this case as company has given her free 3 mth salary to cover maternity.

I work with an education institute for past 3 years. i have applied for maternity leave as per the formalities asked over official email and have submitted my medical also. i haven t received any reply from hr as their intentions are not to pay me. but i have done my formalities. i am eligible for 6 months paid? is there any way they can stop my monthly salary?? also is there any grounds of terminating pregnant women during maternity leave?

Dear friends as per maternity benefit act 1961 any women who has worked at least for 80 days is eligible for maternity leave. now my query is : can a probationer women is eligible for maternity leave who has worked more than 3 months or more? thanks in advance for your valuable input. regards rahul
