If an Employee has completed 4 years and 290 days, is he eligible for gratuity or only on completion of 5 years can the gratuity be given. Is this to the discretion of the company or to be followed as per the law.

Dear Dustven,
If an employee completes 4 years 241 days is enough for eligible to claim his Gratuity amount.

Hi As pon suggested any employee who has continuous experience of 4 Years & 241 days are eligible for gratuity

Hi Friends
One query on Gratuity as part of CTC.
Under the above situation, if employee leaves the company even before completion of 4yrs & 240 days, will the employee be eligible for gratuity!!
Please opine.

Dear RS,
First you know the full form of CTC means Cost To Company means any cost of employees is included in company CTC and Gratuity is also one type of expense for employer after completing Five years of your work than you eligible otherwise not. All year company add this expense in it balance Sheet advance Gratuity provision for all employees. if you not completed than this is not cost of company but if u completed than you able to eligible for Gratuity.

With reference to you quote, Please note that the employee worked minimum 4 years and 240 days are eligible for gratuity.
Also if a company working days 5 days in a week that company employees are should work minimum 4years and 190 days

For computation of 5 years of service plz use round figure rule . e.g. 4.2 is considered as 4 whilst 4.7 is considered as 5. i.e. 4.5 considered as 4 where above 4.5 is considered as 5.
