Dear All,
I have recently joined in a company on March1st, 2013. At the time of interview i marked yes under the column willing to work for 2 years. the office culture and work life is not good hear and i want to leave my job. I had submitted my certificates at the time of joining.
till date i had not taken my joining/appointment letter. i would like to know whether the company can hold my resignation and make me work further. If so, what should i do.

Hello Amarender,

It is very unfortunate to have discovered that.

Lets analyse the good and bad part of your situation -

1. You joined from 1st March, so you completed your 1 month.

2. It is assumed that your name would be there on their muster roll, which gives evidence that you were working from the said day.

3. If they would process your salary it would be easy to prove that.

However,

Since they have not given you any appointment letter or have made you sign a bond for 2 years after your confirmation, you can drop in your resignation letter and resign from the job.

They may tell you that you agreed to work for 2 years by ticking yes on form given to you during interview.

However please note that an agreement is to be drafted post your confirmation.

I mean even after ticking a yes, if you reject the offer, are they to claim you anything?

No. Because you have a right to reject an offer even after going through the interview process.

Since you've worked for one month, it is your moral duty to hand over the resignation and resign peacefully.

Also it was the duty of your firm to give you your appointment letter within a week of your joining.

You are MISSING a point here--Amarender reddy has submitted his certificates....much more important than the Relieving letter, etc, since he worked for only a month.

Yes, I completely overlooked it. Thanks to bring it to notice.
About it, when one resigns, it is expected that the company hands over the original.
Again, keeping original certificates is not a good practice and is questionable.
I do not think in India it is allowed to keep anybody's original documents. Companies always should keep photocopies (or they may ask for true copy in case) and ask for originals only to verify and give it back to the candidates.

In just one month, you have found out that the company is not good. So you will move on to another company and there may also you will come across opinions and judgements from colleagues around you. So you will keep on moving depending upon what others say ! Did you encounter any unpleasant situation or it is the opinion of others ?
Please remember, no organisation is devoid of politics, ego clashes, internal bickerings, back stabbings. After all an organisation comprises of human beings only and no human is perfect. Do you think you are the most perfect human being ?
Instead of listening to what others say and react on that basis, stick on to a company for two or three years, learn new things, develop self-confidence, improve your product knowledge, skills and experience and then move on. Othewise, you will never learn anything on your own but will start believing in what others say from their experience.
