Hello,
I had accepted a job offer by signing the appointment letter and my joining date was after a weeks time. The letter mentioned that "the appointment is in effect from the date of joining duty latest by <date>".
A day before my joining I informed the consultant (who was i touch with the HR) verbally about my decision of not joining, specifying the reasons. After this I did not receive any call from the HR/ Consultant.
2 days after the joining date (I did not join the organization) I am asked by the consultant that I will have to return back the copy of the appointment letter to the HR.
I would like to understand that is it a Industry practice to take the appointment letter back in such case and what would be the probable reason behind it. I am informed by my consultant that they want the letter back in order to prevent any misuse of it.
Any information on this would be helpful.

Decision of not joining any company is solely upto that individual while a company has its own determinations on the legitimate backgrounds. It depends on companies wether they allow the candidate to keep the appointment with them or no. Many take back the letters on the contrary that the candidate do not misuse it for any unethical reason. Contingency to job offers are merely formalities, but other times they can present real challenge to both the employer and employee.
Misuse of any documents have been quite intermittently observed. Henceforth, certain procedural formalities have to be conducted for the good will of either parties.

Dear Neha,
You ought to return the appointment letter so received. Their apprehension must be if somebody says that i have appointment letter and i have not received the salary for this month and my company is refusing to pay me the salary. Though this may be countered but not without some trouble.
Though there is wrong on their part also as at this stage offer letters are generally issued and not appointment letters. They should have issued an offer letter with some days expiry.
As bonafide intentions you should return their appointment letter.

I don't find any strong reason for your dilemma in refusing to return the apptt. letter. (R U sure it's only apptt.letter not an Offer letter). But strictly speaking it's your copy of apptt. letter and you got a right to retain it. How come the apptt. letter you signed is still with you, it should have been collected by them is it not ? If the last date to join duty has already expired and you did not join within the expiry date it automatically lapses with no right to claim back. In order to close the issue you can just send a letter to the Consultant intimating them your inability to join the post, it should suffice.

Hi Neha,
I am a little in dount as to the intention behind asking this question.
Are you only curious to know if it is normal to ask the appointment letter back or you do not wish to hand over the appointment letter back to the company?
For the former reason, these days many companies ask the appointment letter back form the candidate who do not join.
Appointment letter are meant for people who are working in the organization, rest all can have offer letter but no appointment letter.
I had an employee who came to collect his appointment letter and his joining was next day. He informed over call that he wouldn't join.
It was fine, it was his call to join or not but we asked him to send us our appointment letter so that we can keep in our records that the offer was cancelled without prejudice.
He handed it over back.
If incase you are not wanting to handover the letter back to the company, may I ask the reason for it?

Hi Neha,
When you have decided to reject a job offer, you may want to let the employer know in writing that you are declining the offer. Your letter should be polite, brief, and to the point. You don't want to burn bridges and this employer may have a better offer for you down the road. So, don't get into any specifics.You should include the followingwhile writing to the HR who has made you the offer:
•Thanks and appreciation for the offer
•Written rejection of the job offer
Include your contact information and phone number, even though it is on file with the employer.
Make sure that your letter is well written and does not contain typos or grammatical errors. Even though you are declining the job, you want to make sure all your correspondence is professional.
Being a HR professional, I clearly understand why the appointment letter is being asked back. However when you send this mail, it would suffice. Its a backup which will be added to your file.[/U][/B]

Dear Neha ji...
Though there is no rule or law by which you ought to return the ( Appt. Order) AO to the originated Co.. They also may be right by asking the Appointment in their way for a chance of mis-use the AO by you in the later days.
In your case............... when you are not interested in joining the concerned co., who sent the AO............. then what is the necessary to hod the AO on your hand........... and hence you may send it back. After the mentioned date within which they have asked you to report and you did not report within that date......... then automatically the AO is become void for both to YOU as well as for the Co.
By keeping the AO with you you may certainly may not gain any extra energy..... so pl. send it back to avoid any consequences. OK.... for any further doubt pl. send me mail to my personal id : "

Dear Neha,
If you are not joining the organization for which ever reason it is .. the appointment letter should be given back the concerned HR or at least courier that if you are enable to give it on hand.
