dear sir madam,
as i know that under the factory act1948 those establishment r eligible which must employed more than 10 employee in case of aid of power or 20 in case of without the aid of power where manufacturing process goes on. but kindly help me to know that will factory act be eligible in the Head office or corporate office of its respective factory.

Dear Paras Thakur,
If manufacturing process not going in your Head office or corporate office. Then your Head office or corporate office not covert under factory act. Your Head office or corporate office covert under Shop & Establishment Act.
But if any types manufacturing process going in your Head office or corporate office it will covert under factory act.
if you need more clarification please revert.....

Thank u sir for your reply. i am having another doubt...
Gratuity=( Last drawn salary*15 days salary of completion of every year*no. of working year)/26
in the above formula why is it required to take 15 days salary of every year.
Plz Kindly help me....

Hi Paras Thakur,
For every completed year of service or part thereof in excess of six months, the employer shall pay gratuity to an employee at the rate of fifteen days' wages based on the rate of wages last drawn by the employee concerned

Dear Thakur,

You may be aware that the quantum of fee for the application for the registration depends upon the maximum number of persons employed during the year and maximum amount of power ( in terms of horse power) installed or proposed to be used. As such if your Head Office or Corporate Office is located in the same premises where your factory is carrying out the manufacturing process and you have, while applying for the registration, included the persons working in your Head Office or Corporate Office and have been sharing common power meter then definitely the provisions of the Factory Act will apply to your Head Office or Corporate Office as well. You should be cautious for this part as well make sure that while filling the application form for the registration, the full name of the factory is mentioned in Column 1 specifically mentioning EXCLUDING Head Office or Corporate Office, as the case may be.

As regards the clarification with regard to the Gratuity is concerned, Sh Kuldeep Rawat has given the correct position of the provisions under Payment of Gratuity Act.
