Sir pls help me i am working with a company where is 15 person are employed we use power but the electric meter is landlord name we pay only building rentin the same permises other shed different name factory working which is covered under the factory actsir pls tell me we are covered under the factory act if we are covered we need a seperate factory licence or not hitesh kaushik

Sirs would like to know whether the factory act becomes applicable from the day the drawings/plans are submitted with the factory inspectorate office or from the day the manufacturing activity is started. secondly if the manufacturing activity is not started and the other conditions i.e use of power dg sets and more than 20 employees have been engaged will the factory act become applicable. request all seniors to share their views on this as the same is urgent. regards anand gaur

Dear seniors. do help me with my confusion related to the working hours as per the factory act: 48 hours is the maximum limit for a oneweek work capacity and the employers are flexible to choose this work time and make it available in 4 days 5 days or 6day week structure. 1 in 4day week structure 12 hrs is the spread over where working hrs is 5 hrs work0.5 hrs rest5 hrs work0.5 hrs rest1 hr work in this system if a worker exceeds 12 hrs but not more than 30 min is he eligible for overtime? 2 what will be the working hours for 5day & 6day week structure? what will be the overtime rule in both the cases? 3 what is the percentage of basic pay? is it 50 of ctc or gross salary?
