Dear All,
I am Rajini here working as HR Executive in PALACE TOYOTA dealers of Toyota Cars.
My query is whether we can exempt the employee from PF by fixing the basic salary of Rs 6600. If an employee is eligible for PF in previous company and we can exempt from PF in his present company or nt. PLS SUGGEST.
If an employee salary increases from 10000 rupees to 15200 rupees as Gross salary in the month of May how we should treat him in ESI filing.

Hi Rajini,
PF: The national ceiling limit of Basic for PF exemption is Rs. 6500/- but once an employee covered under PF (when the basic is below Rs. 6500/-) cannot be exempted even if Basic increases to/above 6500/-
Similarly, if the employee is a member of PF in his previous organization he cannot be exempted in your company UNLESS he shows 2 months of gap in his employment. Form 11 mentions the same.
ESI: If the gross salary of an employee crosses Rs. 15000/- in the month of May, ESI should be deducted till September. From October, you can stop the contribution towards ESI.

Thanks a lot.
But we have exempted the employees from PF and there is no gap of two months from the date of resignation and joining date.
wt can b done in this case.
We need to file a ESI contribution on entire 15000 rupees excluding washing allowances right.
Pls let me know the Statutory Returns to be filed annually.

In that case you are flouting the law. But now that you've done so you still need to make them fill Form 11.
Contribution of ESI will be on actual gross salary earned i.e. where the gross salary of employee is 15500/- the ESI contribution will be on 15000/- assuming 100% presence but if he happens to attend office for less then 30/31 days the actual gross shall be below 15000/- & hence the contribution will be on the such earned gross salary.

thanks a lot fr u r valuable reply. Will get it filled FORM 11 by all PF exempted employees. Wt n all statutory returns to be filed by the company which is registered under the Factories Act .
