Dear All,

I would really appreciate if you could provide me any help concerning my query, mentioning below:

Company is registered under shops and establishment act. As per this act, minimum 15 days as PL to be given annually and can be accumulated upto 3 years.

I am to prepare F&F (full and final) settlement for resigned employees.

Company does not have any leave policy and though has mentioned in T&C of the employees that they would be given 30 days as PL annually. Till what period, it can be accumulated, it's not mentioned.

Also, seems company does not have standing order.

My senior told me that company does not let it accumulate beyond one year. Previously, they used to encash accumulated PLs after every year. But now have stopped doing that. They asked employees, only verbally, to avail all PLs by end of the year and said that they would not encash it.

pl note one thing more, company did not maintain leave account of employees also. So, it's been difficult up to how many days, PLs can be given to those resigned employees.

Not 15 days 12 days per year... not 3 years its upto 36 days after it will be saturated....

not 12 but it should be 15 in a year and encashment should be done upto 30PL and upto the three years above than 30 above time frame the leave should be lapsed no encashment should be done. sumit

Dear Vishal,
First of all. It is mandatory to maintain Leave records of the employees. You can download leave tracker from Cite HR. You can go through Leaves related topics to get more clarity. Leaves can be categorized in to CL's, SL's and PL's. CL's and SL's will be lapsed at the end of each year, where as PL's will be carried forward to the next year. Pl's can be encashed. They can be carried forward until three years. They will be lapsed automatically after three years. Anyways that depends on your Company's Leave Policy.

Also let me know what is the maximum limit for PL encashment if it is allowed for accumulation upto 3 year. in case you have any law/case authenticating the maximum limit for PL encashment, pl share that also.
