Dear all i have one query regarding gratuity. actually i have joined one firm recently they cut my salary by the name of gratuity even if i haven t completed my 5 years yet in this organization. please tell me can they do that? can they cut down my salary by the name of gratuity reimbursement. please solve this query with detail. regards shweta

Dear seniors i have few query related to gratuity 1. suppose an employee works for 11 year continous service in any organisation can he take gratuity twice say after 5 year and then after next year . 2. can we count notice period for entitlement of gratuity during full 7 final settlement. 3.i have seen various comment some say person should have worked for 5 year for gratuity entitlement few says he should have worked for 240 day in 5th year which one is correct as per statutory provisions.big confusion. 4. what is the purpose of gratuity insurance because in few ctc structure gratuity as well as gratuity insurance both are part of ctc. . regards

Hi had a query with regards to gratuity application. we are a organisation of 25 and has been into existence since 2005. we are taking up gratuity benefit for our employees and was trying to calculate the of basic which should be considered monthly as gratuity. in the whole process realised that if an employee completes 5 years and has a yearly increment of min 1520 on his salary how is the liability of employer justified when we consider the 4.81 of gratuity followed by companies generally and the gratuity payment post 5 years will be based on last drawn basic salary. please clarify. raj

Hello friends i have a query wrt gratuity payment. what is the rule on the payment of gratuity for an employee who had been transferred within a group company and now if he decides to quit the group after serving for 3 years and 2 years with parent company? is he entitled for gratuity or will it be considered as a new company?
