According to ESI Act if an employee gross salary is more than 15000 due to increments,Is he applicable for ESI?

Due to increments or promotions if employee salary increases then he/she is not applicable for ESI benefits. More over he/she has to contribute till the half year period that too the deductions shall be restricted to 15000/-.

Dear Annushaavaddi,
Under ESI Act, there are two contribution periods and two corresponding benefit period. If salary of an employee is more than Rs. 150000 in the beginning of contribution period, he should be de-covered from ESI. If the salary is increased in between the contribution period, the employee is continuied to be under ESIS till the end of said contribution period.
As regards to benefit, the employee is entitled to get benefit till the corresponding benefit period gets over, subject to certain conditions.

As per the Employees State Insurance Regulation 1950 a person who becomes an employee within the meaning of the Act for the first time, the first contribution period shall commence from the date of such employment in the contribution period current on the that day and the corresponding benefit period for him shall commence on the expiry of the period of nine months from the date of such employment. Meaning thereby the benefit will start from expiry of nine months from becoming the member likewise even if someone out of the preview of the Act by virtue of increase in the salary (above Rs. 15000/-) one will get corresponding benefits up to next nine months from such the date.
