Dear All,
Good afternoon!
I am facing a problem concerning payment of bonus to off roll employees. pl confirm me whether payment of bonus can be made to employees working as off roll. They don't have any salary break up and also, assume we dont have standing order of the company. In case they are to be given bonus, will it be calculated on the basis of stipend?. . since we aren't paying them salary.
I know employees working as trainees/off roll but not covered under standing order of the company are eligible to get the same. Pl give your comments on same.

Thanking you for answering me.
First, let me make you aware of the condition. we don't have any contractor. we are employing a no. of people as off roll and also they have not been issued any appointment letter. They are being paid in cash term only. So, this amount can be considered as stipend.
I know that if off roll employees are being benefited by principal employer under ESIC, even though they have not been issued any appointment letter, they would be considered to have been employed by principal employer.
Here, my question is... in such condition, can they be given bonus? assume, we dont have standing order. And also confirm, if they would be given bonus, will that be calculated based on stipend being given?

Irrespective whether the appointment letters issued or not these "Contract Employees" are your employees. So morally you should pay bonus to them......

Hi, Maybe you can Pay them Half salary (If Stipend is Rs.8500/- per month, 50% i.e Rs.4250/-) of the month as Annual Bonus.
