Ms. Suneeta, i've a staff who have tendered her resignation with 1 month notice... meaning that her last official working day would be 24th Nov'12. she has not shown up since 5th nov'12 till todate without any information.....the immidiate superior tried calling her bt she fail to response in any manner...and yesterday i managed to reach her husband who said that she won't be coming in to work after this.....so this shows that she has no interest to work further and terminated her employment....pls adv what should be done!! tq.

Hello Anushka,
Like Suneeta mentioned, your use of vague & unheard-of terms ["self termination"] in your opening posting confuses things.
Coming to your situation, just follow the rules of the company & the terms as mentioned in the Offer/Appointment Letter to this employee. This seems to be a clearcut case of an employee not serving the Full tenure of the Notice Period and, presumably, not handing-over properly. Where's/what's the hold-up?

Anushka, This is the case of termination not self termination you can terminate her on the ground of absenteeism..

Dear Anushka,
As u said that as per her resignation and her notice period she should be relieved on 24th November. and she didn't come to the office after 5th November.
I am of this view that a person can enjoy his/her EL during notice period. So, u do one thing If she is left with her earned leave, u adjust the same for the time period she didn't shown up. And if she don't have any E.L, u can deduct her salary for that month. I hope this will serve your purpose and i guide u in the right direction.
Instead of Termination procedure u can do this in this way.

I am still of the opinion that Termination can take place when she's not put up official resignation. In her case she has put up the resignation so I didn't get the logic behind you terminating her now. You might invite legal issues if the employee wants so.
You can instead give her a written reprimand to finish her notice period & settle her account or she would be considered as "ABSCONDING DURING NOTICE PERIOD" & put her salary & other things on hold or adjust the 20 days pay from her full 'n' final settlement whatever is your companies/managements say on it.
