F&f without noc - should i mail to the company hr that i don't accept the peanuts they are giving to get rid of me?
My company terminated me because of 19. i have lodged a complaint to the mumbai labour commissioner about nonpayment of any severance pay. i have not given any noc to the company but they have transferred the full and final payment to the salary account. they have not given any breakup of the payment but from the amount it is understood that it is the last month s pay which was on hold some loose change possibly from leave encashment etc. the labour commissioner has still not responded to my complaint. i want to have a hearing from the government on the case because i think the termination and nonpayment of severance is illegal. should i return the f&f to the company? should i mail to the company hr that i don t accept the peanuts they are giving to get rid of me? i lodged the complaint before the payment and i don t know when the labour commissioner will respond. i only have a complaint number from the online portal.
How to file complaint against my company in labour court
Hi all i am working in a private limited company as hr manager and company management not paid my salary since 7 month. i tried to complaint i. chief labour commissioner central but labour inspector said you are not fulfill workman definition so we are unable to register your complaint. please suggest me what should i do.
Asst. commissioner says they can terminate the employee if he/she is in probation
This is to inform that my wife was working in a pharma company. they recruited on permanent roles initially as a replacement for a lady who went on maternity leave. however once the lady came back after 4 months. she is a executive assistant to coo however they started harassing her on work so that she should resign. one day they orally told her that they will terminate on performance grounds and then took a physical handover of the company assets. i as a husband raised a complaint to hr saying harassment at work marking copy to commissioner of police commission of labour & national woman commissioner. based on the complaint they then sent her a performance improvement plan and show cause notice as to why she brought her husband to hr without prior information. however we raised a written complaint with commissioner of labour & national women commission. based on the complaint they then after 2 weeks they have sent a letter of termination on the grounds of absconding. now we showed the same letter to labour commissioner and he has asked for a joint meeting. however the asst. commissioner says they can terminate the employee if he/she is in probation during her probation period. as per the appointment letter they mentioned that 6 months will be probation period and can terminate. however in the next point it is clearly mentioned that "either party has to give 90 days notice to leave the company". based on this point we wanted to get 90 days payment in lieu of their termination. and now i feel the labour commission is biased. kindly advise how to take this forward just in case we do not get justice at labour commissioner office.
Threats by ex-employee - going to labour court and filing complaint against us
An employee of my company has left our office without proper handover. after going through his work we found out that there are some discrepancies in his work and he has fooled us by not completing the designated work. after discussion with him we told him that we will give you full and final payment once you provide us the work but instead of completing his work he has started sending mails like going to labour court and filing complaint against us. kindly suggest being an employer what steps can we take? it would be really helpful if you can share the information at the earliest.
Full & final pending & employer not responding to labour commissioner
Dear respected i have worked in the company for 6 months and have resigned in probation by serving the entire notice period and have obtained a clean relieving letter. i have approached the labour commissioner for my full&final duesonly salary amounting to around 1.3 lacs.but its been 4 months now that iam still awaiting my dues.i have tried approaching my management through whats app messagesmails and have been stopped entering the office gates as well.when i complained about my bad experience on mail to them keeping the labour ministry in cc the management has reverted saying my allegations are baseless and they will file a defamation case against me.and i need to apologise to them on mail and collect the dues cheque from their office.also the management and mewere called by a letter by labour commissionerbut the management have not come. kindly suggest how do i take things ahead..alsoif the management is not paying heed to the labour commissioner letter then what is the next course of action to be taken. kindly throw some light on the powers of labour comissioner. can he close the case by asking the employer to pay my full&final dues? or do i need to knock the court doors? also as an employee; under which act do i fall under labour tribunal and under which act;if my salary is more than rs.10000/ monthly and i have been given a managerial post; but was made to do all clerical works.i had a team mate under me who was based out of some other location;and whose only attendance used to come to me.i have not even met him. kindly revert what amount of compensation can i claim from the employer; against mental harassment and agony. regards.
Previous employer never pay full n final settlement amount from last 3.7years
I was working as a manager in previous company my previous employer never pay my full n final settlement amount from last 3.7 years. he always say will pay soon. but till date no payment received. i also lodged a complaint against him in pune labour office. there were he give written commitment in dec 2017 that he will start to pay partially from april 2018. but till date he never pay single rupees. i am continuously taken followup on email he never receive my phone calls. he only send two line reply on mail that situation is bad & wait for some time. he is never give any firm commitment regarding payment. what can i do now???? can i go to labour court? or give your best advice to me. please reply
