We are a media company. We give following leaves/year as following
SL- 7
CL- 7
PL- 30 (2.5/month)
Now there are employees who have accumilated more than 30 PL's. Some are having 80-90 PL's in there account.
Please suggest how many leaves an be cashed at the time employee quits.
Is there any specific policy in regards to PL leave management according to govt. rules.

Hi ,
There is no law on how much leaves has to be encashed.
But its company who has to decided while forming a leave policy to his employees .you state in your leave policy that PL's can be carried forward and fix the limit .
If there is any excess leaves than fixed such leaves will be lapsed automatically .

AFAIK, PL/ELs are not lapsed automatically but encashed automatically beyond the threshold limit. Pls note that the accumulated leaves are Earned or Privilege Leaves and it is not fair to lapse such leaves. I do agree on the lapse of CLs or SLs but not PLs. In my company, the unavailed CLs are also encashed at the end of the year.

No, most companies have a rule of maximum number of days for which PL can be carried forward. The rest has to be used or it will lapse.
There is no provision in law for encashment of leaves. It is against the spirit of the general provisions of the labour acts. The idea is to give the employees time off for rest and recreation and for personal matters, not to give them more money. Cap on leaves carried forward furthers the same policy that the employee must utilise his leave not over work and burn out.

Ok, Factories Act also says generically not more than 30 PL\'s be carried forwarded.
But can you put some light on the leave encasement of GOVT. employees at retirement. If I am not wrong 10 month leave are encashed in case of Punjab govt employee and same applies for central govt employees; Under which rule this is done?
