I Request any one please sort out my query?

Currently we have six employees in our organization.

Will we have to implement ESI/PF in our organization?.

We further plan to recruit seven employees more for our operations

We have two plan in our mind

Plan A:As per Plan A we are going to call and give 7 people for job orders which should be performed in our company for whom depending upon the orders we shall pay them accordingly.In such case will ESI/PF must be implemented?

Plan B:If we recruit 7 peoples as temporary employees and pay them monthly salary of Rs.4000 each our organization employee strength will add up to 13 employees(Permanent Employees: Existing 6 Employees + 7 planned recruiting temporary employees= total 13.In this case will we have to implement ESI/PF in our organization?.

In the above 3 cases, for which plan I have to implement ESI/PF in my organization?.

If not why so?. Please explain me this and help me out dear seniors.

Hi, Until you cross the limit of 20 numbers of employees in your organisation, it is not required to do registered under the EPF / ESIC.

Thanks for your advice.
I have a doubt
Recently few of my wellwishers say that if employee strength is 10 or more than 10 one should implement ESI in a company.
And for EPF if employee is 20 or more then EPF should be implemented.
Is it true?.
Plz advise me.

Hi,
Pls read the "APPLICABILITY"
Under Section 2(12) the Act is applicable to non-seasonal factories employing 10 or more persons.
Under Section 1(5) of the Act, the Scheme has been extended to shops, hotels, restaurants, cinemas including preview theatres, road-motor transport undertakings and newspaper establishments employing 20* or more persons.
Further under section 1(5) of the Act, the Scheme has been extended to Private Medical and Educational institutions employing 20* or more persons in certain States/UTs.
*Note: 14 State Govts. / UTs have reduced the threshold limit for coverage of shops and other establishments from 20 to 10 or more persons. Remaining State Governments/UTs are in the process of reducing the same.
The existing wage limit for coverage under the Act is Rs. 15,000/- per month ( w.e.f. 01/05/2010).

Which company comes under non-seasonal factories?.Please quote me an example.
And another thing is we have the company in Chennai.
Does Tamilnadu State government comes under the threshold limit for coverage of
establishments from 20 to10 or more persons.?

Can anyone tell me, Is PF withdrawal applied only if a employee worked more than 6 months? Employee who worked only 2 months are not eligible for PF withdrawal?

Dear Mr. Vinod,
Not Necessary, Employee can withdrawal his/her provident fund less than 6 months worked but he/she can not withdrawal of employees pension fund less than 6 months services.

Dear all,
can any one tell me ...
we have a employee working in our organisation,,, above 60 yrs. Still his pf and epf amount is remitted every month.
is it necessary to remitt his contribution ,, is he still under the preview of the act..
