We are a company with less than 10 employees but more than 10 when we include the contract labor4 contract labour. they are asking us to furnish form v under contract labour law for registration of esi. since we have not crossed 20 employees we do not fall under contract labour law. is it mandatory to provide form v to contractors even though we do not fall under contract labour ? is it required to obtain any other labour license like the west bengal labour welfare board ? one of our employee has a gross salary of 15000 but after deduction of p tax her salary is less than 15000....is she eligible for esi ? it it necessary to get hold of a registration under contract labour act in order to appoint 4 number of employees under contract?

Dear modi if you have to engage the contract labour then you must register your organisation / factory as an establishment under contract labour act for which you have to use form i. alongwith the form i you must submit a list of contractors you are planned to engage. whoever contractors name you have submitted while obtaining the registration certificate for them only you can issue form v. if you want to engage a new contractor then you have to submit for additional list of contractors whose name to be added on the register of contractors which is maintained at labour commissioner s office. as per central act if the workmen strength is less than 20 then the contractor is not required to obtain the license but for state it differs from one state to other. so you will have to refer the state rules to get the correct information.
Pf query for contract labour
Dear friends our s is a manufacturing company in maharashtra not yet operational. however we have employed some 500 local people contract labour through 5 local contractors. these contractors do not have a permanent work order from us. also they have newly opened their contract enterprises as earlier they were doing some other jobs. now these contractors do not have a pf allotment code business no.. instead of giving pf allotment numbers to 5 contractors we thought of having 1 main contractor & under him we will put these 5 contractors which will be known as subcontractors. kindly inform regarding any legalities on this point ? i am supposed to visit pf commissioner very shortly as directed by my management. plz let me know the obstacles / queries here that can be asked ? request an early response. best regards shaunak marulkar 9423877450 pune
Registration of contractor under the contract labour (r and a) act.
The application of contract labour r and a act 1970 applies to every establishment in which twenty or more workmen are employed or were employed on any day of the preceding twelve months as contract labour. the situation: 01. the establishment has outsourced some of the work on job contract and the total number of workers engaged by its job contractors are more than 20. the organisation has therefore registered with the regional labour commissioner as principal employer. 02 each of the job contractors are however engaging less than 20 persons therefore the regional provident fund commissioners office is not registering these job contractors for depositing the pf contribution of their workers? 03. as per the epf & misc prov. act 1952 the coverage is extended to every establishment employing twenty or more persons. there is a dicotomy in the situation how do we go about it? what are the implication?
