Dear All,
I was the member of PF in my prebious job but bow I have changed my job, please tell me if I can opt for PF exemption in the new organisation so that there should be any deduction of PF. My basic salary is above the limit of PF.

An employer who encages more than 20 employees are only entitled to enroll in the EPF. If in your present organisation if there is only less than 20 employees then you cannot be enrolled in the EPF.
If in your organisation if there is more than 20 employees then you are entitled to PF even if you have crossed the EPF limit and it is only possible if your employer has taken a policy that all the employees who have crossed the EPF limit need to be covered.
ie if your employer decide to cover all the employees irrespective of their salary under the EPF scheme then you will also be entitled and otherwise you will not.

Dear Shri. Narendra ji,
What I understood is, you wish to be excluded from coverage of EPF on the basis of your basic is now more than Rs. 6500/- p.m.
Employee once covered under EPF has no option to be excluded from EPF on exceeding his salary beyond Rs. 6500/-p.m. even-though he has changed his employment.
Form 11 is compulsory at the time of joining the employment and on the basis of this form the employer has to decide whether the new joinee is to be excluded from EPF or not.

It is true that when a employee is covered in PF then irrespective of the increase and decrease in his salary he is entitled to pay PF if he is working with the same employer. But If the employer is changed and the employer has taken a policy that no employee who earns more than Rs.6500/- is not entitled to enroll in the EPF then the employee has a right not to pay PF when the salary is more than 6500 when the employee joins the new company.
