Dear All,
I have the following quries related to termination .
1. Our organization is a distribution company ( semiconductor components) ,wether we come under ID act ??
2. Bangalore is the HQ in india.
3.Recently we terminated an associate ,who's behavior was not correct also he was cheating the company on conveyance allowance.so management decided to terminate him ,on his LWD one of manager spoke him and asked him to handover the company assets to office assistant .
But he did not do so ,he carried the note book along with him and now he is asking for his salary and conyenance allowance we have agreed on this .
He is ready to do this once the due amount is credited to his account.

Industrial Disputes Act applies to your co because it is an industry by virtue of Bangalore Water supply's case, which states 'any systematic activity carried on with the cooperation of persons for the satisfaction of human wants'. Before the termination of any employee for a misconduct, you need to follow the disciplinary procedure of issue of charge sheet, conduct enquiry and if the misconduct is proved, then issue termination by way of punishment. Now, the employee may file a case for unlawful termination in the labour court and ask for reinstatement. You have to be very careful in your communication with him both oral and written to avoid any adverse order against you.
