Hi friends , i was going through with all the stuff relates to above mentioned topic , Occupier, i am unable to understand what is actual conditions to be occupier of a plant.
We got our occupier changed, earlier it was one of our director, but now we received a Board of Resolution stating that our new Plant occupier is Our Plant Manager, i sent Form No -2A to the concern Govt Aujthority, but i got a reply that you need to send the list of diorector again which should include the name of your present occupier as deirector, now i am confused because our present palnt occupier is not a director. what reply should i send , have we made mistake or what is actual condition which law allow??? kindly reply me ....ASAP

By virtue of provisio to section 2 (n) (ii) a director is DEEMED to be an occupier.It is also a fact that the Occupier need not be a Director of the company. If so, the public sector undertakings cannot practically function. Therefore, get a Board Resolution appointing your Plant Manager as the Occupier under the Factories Act.

Dear Member,
After going through your brief your case for declaration of occupier falls at sec. 2(n)(ii) of the Factories Act, 1948. Accordingly you are to declare one of the directors to be the occupier in place of already declared occupier in Board of Directors meeting to be held for this purposes.As this is a case of company & therefore, in my opinion the Govt. authority is considered to be right in asking you to declare one of the directors to be 'occupier' under this Act.
