Please could somebody help me. We are a service oriented organisation. We have received a resignation letter after one year from an absconding executive leaving the organisation. The reason he has now approached us is because his current employers are not taking him.
What is the normal course of action to be followed in such cases.

Dear Dwipna
Generally the company takes the follwoing action if the employee is absconding without submitting resgination or without fulfilling the mandatory relieving formalities.
1. notice is to be served for clarification of absconding.
2. if employee doesn't reply , then u can claim for compsensation which caused loss to employer in his absence .
u can take legal action as per company rule and regulations.

This is the practice which we are following now. But in this case he had just disappeared about a year ago without any information after taking his salary. Hr department has been established in our organisation for the past one year only.

HI,
Well it happens at times that employee absconds and comes back to us for various reasons. For Full and Final Settlement, For experience letter , For PF withdrawal etc..
In case the employee is coming back to us after one year, what I feel can
be done is take the back dated letterwith last working day date and complete the Full and Final. formalities. This is an easy solution.

Sir,
If we accept the resignation letter in back date from an absonding employee we are in fact encouraging them and at the same time sending a wrong message to our employees. The number of executives who abscond is on the rise. They just wait for the salary and disappear. Do we in the HR fratanity want to encourage this practice.
