Dear All,
Under Factories Act 1948, all persons working within the premises are termed as "Workers". If this defination is right, then the queries are
1. How are the Management Staff and workers differentiated under the Act.
2. For which type of workers is Overtime applicable.
3. If Mgmt staff are also considered as worker then why can't they claim Overtime under the act.
4. What is the applicable limit per period of Overtime defined in Factories Act, to be specific Applicable limit is hours of overtime fixed & Period is weekly/monthly/quarterly etc.

Read Section 64 of the Factories Act this Section provides for State Govt to define Supervisory and Management staff who will be exempted from the provisions of this Chapter dealing with Overtime and and spread overs
Hence those holding positions of supervisory and management will not fall within the purview of these sections
