Dear friends though this earned leave encashment is being discussed at different times and forums still there is some difference of opinion. section 79 of the factories act 1948 says that every employee who works for 240 days in the previous year is entitled to earned leave 1 leave per 20 days of working. when the worker is discharged or dismissed or quits employment the unused earned leave at his credit has to be paid. a worker is entitled to accumulate upto 30 days of earned leave and over and above 30 days will lapse. suppose a person who is having earned leave at his credit more than allowable 30 days and has not taken leave nor organisation didnot allow him to take leave then the additional leave is to be compensated or encashed? is this the company policy or is it mandatory? this is not very clear in the factories act. i invite our learned friends to post their views along with mandatory laws/rules if any for the benefit of hr people. srinaren
Is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?
Hi please tell me how do we calculate leave encashment. for eg: monthly gross salary is rs.10000/ out of which basic5000 hra2500 medical1250 conv800 misc allw450 then how much would be leave encashment of 5 days?? is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?

Hi group i am currently remaking the company s leave policy. the earlier structure of leave does not have the provision of the encashment of leave. now i want to incorporate the encashment of leave also. kindly guide me regading the encashment of the earned leave as we donot have the provision for encashment of sick/casual leave. plz help prachi

Dear all i request your suggestion on encashment of earned leave. i am leaving my present company and as per our personnel manager i am not entitled to use el during the notice period my earned leave will get lapsed and as per the company policy they will not be encashed either. i would like to now 1. whether el encashment is subject to company rules and policies. 2. will it be possible to get any help from the law. thanking in advance to the responding members. rajneesh.

Dear all we are in a process of reformulating our leave policy. so need suggestions and input on "how important it is to pay leave encashment against earned / privilege / yearly / annual leave" in case the leaves are neither lapsed nor utilized by the employees as currently it is entirely managements discretion to allow the encashment of leaves to some employees who did not take a single earned leave in the past years. and also at the time of settlement should a company pay the encashment for the earned leaves to the resignedemployee. your input is really important.
