Dear all i am resign form company in my probation period as per appointment letter there is clause for termination is 24 hrs. in probation period and separate clause for notice period is maintained that required to give in writing 60 days notice. please help me which notice period should i consider. please advice me what to do if i want to leave within 4 days.

Dear seniors greetings for the day i work in a small company registered under shops and commercial establishment act. and work for the hr department from past 2.10 years. recently we had an appraisal discussion and received the appraisal letter with a normal hike and clause mentioned on notice period in the appraisal letter this is first time am seeing in appraisal letter. am worried about the clause which is mentioned in the letter as the notice period/the termination clause been changed form 1month as in offer letterwas agreed earlier to 3months in appraisal letter. my questions are 1. maximum how many days can an employer ask for the notice period? 2. can the notice period clause change in appraisal letter? 3. is there any law on the notice periods for the organizations in india? pls help me on the same as am worried about the clause of notice period and have not accepted yet. i feel this will affect on my carrier growth. pls suggest me how to go in this case. warm regards praveen devadiga

Am working with very growing company. attrition rate is too high in all departments.50 in marketing that s why since long as per top management instructions we are not issuing appointment letter. senior & middle level employees are leaving without notice period. work suffers due to them. instead of issuing appointment letter to existing 700 employees what would be the best solution we can have they should leave with notice period. 1 can we mention clause in appraisal letter for notice period? 2 can we mention notice period clause in offer letter for candidates?
Notice or salary in lieu thereof
Dear hr gurus i am in dilemma regarding the "notice period" clause of appointment letter. my query: is it authentic to have only notice period and not salary in leiu of notice: for example can we have the clause this way: either party the employee and the employer can terminate the employment by giving one month s notice. is it mandatory to have the option of salary in lieu of notice? i would eagerly welcome your recommendations. thanks
Notice period during probation
Hello i need some clarification regarding my resignation. i have been serving my notice period. i have completed 1 year in a entry level engineer position. now i have received an offer which is my dream job and the joining date is 08022016. i have resigned from my post on 2101.2016. now my hr is telling me that i should serve notice period for not less than 2 months which is not possible for me. i have stated my notice period and probation period clause. please help me on how can i use these clauses and reduce my notice period. i have 14 days unused of paid leave. note i received one more appointment letter after six months because of some small change in company s operation. in the first appointment letter the probation period clause is not at all there where as in the 2nd appointment letter the probation clause is there as stated below. notice period clause: your services are subjected to termination at any time by giving 60 days notice in writing without assigning any reason thereof. you may also terminate your employment with us by giving us not less than 60 days notice in writing. shortfall in notice period from the employee s side would be recovered from the employee. however under specific circumstances with prior approval from the manager the shortfall may be adjusted with the unavailed paid leaves or completely waived off. probation period clause: as per the terms of employment with xyz company you were on probation for a period of 6 months from your date of joining. you will continue to be on probation for the unexpired portion of the probation period and xyz company reserves the right to extend the probation period based on your performance. on satisfactory completion of probation we will inform you in writing whether we can confirm your appointment and you shall be deemed to be on probation until so confirmed in writing. please help me.
