Labour contractors: minimum mandated charge for the services provided by the contractor?
Labour contractors are obligated normally to pay minimum wages as applicable to the type of job and the minimum wages mandated by the state or central govt. in addition to the minimum wages esi and epf are also charged. however i am not aware if there is a minimum mandated charge for the services provided by the contractor. this is separate and not to be confused with the service tax which is mandated by the govt. the reason i am posing this question is some labour contractors are not charging any amount for their services and quote the minimum wages plus esi epf service tax etc. but the organization which accepts such service from the labour contractor nevertheless deducts 2 as tax deducted at source tds. so if we back calculate the law on minimum wages would have been violated. please enlighten me if the labour contractor is obligated to charge a minimum amount for the service provided.

Hi there one of the good industrial organizations are enganging contract workers in the main production or manufacturing process for support to their regular workers. is there any restrictions under the law for enganging such contract labour to the main production activity for any organization? also if the contractor is not paying minimum wages as per the prescribed applicable minimum wages act . is there any binding for the principal employer to pay the wage according to law? or should have to pay the difference of the decided minimum wages and the actual paid wages by contractor please advice in this regard... possibly through mail. atul atulsmalve26yahoo.com

Confusion regarding minimum wages
dear seniors i need some clarity regarding minimum wages. 1 is minimum wages stands for only say minimum wages for skilled is rs. 5000 & our company pays to skilled staff as follows : 4000/ mobile allowance 1000/ total figure comes equivalent to minimum wages i.e. rs.5000/ is it ok as per the labour law or should i revise it. waiting for your valuable guidance. best regards amod
