If Nepal residents are working in Nepal with Indian company what will be those employees liabilities to ESI and EPF and where it must be deposited.

As far as ESI is concerned they are covered by ESI Act and contribution should be paid at the place of their working, ie, in India. for EPF also the same rule applies but I doubt if they come under international workers and if so their contribution will not be limited to 12% of Rs 6500 but the entire PF qualifying amount (Basic+ DA mainly) paid in India will attract PF. But I am not sure whether persons of Nepal origin migrated to India for permanent settlement in India is a foreigner whose details are required to be given to the nearest Police station etc. If they are free to do job in India, they will have same status like any other PF member.

Point is this that an Indian Company is expanding its business in Nepal and it wishes to recruit Nepal Residents in its Marketing division at Nepal. What will be ESI and EPF liabilities for Indian Company to such employees. If the company deduct ESI and EPF of those employees can they avail ESI benefit in Nepal and what will be fare practice of PF for those employees.

In that case, the company is bound to honour the social security schemes of Nepal and not our ESI and EPF. If the operational head quarters of the company remains in India, then the EPF will become applicable to the Indian employees employed in Nepal.

Will these employees be considered as international Worker and which criteria of PF deduction will be applicable for such employees. PF deduction will be either on actual Basic salary as for International employees or as per norms applicable to Indian Employees.

If an employee is posted in Nepal, the law of that country will be applicable There are social security legislations available in nepal and you must refer to them Sivasankaran
