Hello,
An employee committed suicide and the deceased's family have taken the husband of the deceased to court that the husband committed homicide. The trial is not completed yet so there is no verdict if the death was really a suicide or a homicide.
The nominee for the terminal benefits is the husband as per the declaration. Can the father/mother of the deceased claim the terminal benefits from the employer directly even though the nominee is the husband who is the accused in the alleged homicide ?
Terminal Benefits are P.F and Gratuity.

Pl. get in to unncessary legal issues, ask them to obtain a legal heir certificate so that you can pay to those people. If one or more people approaches then don't pay anybody and ask them to get the issue cleared by the court and then pay. In the meantime better to inform the concerned labour department officials so that you don't have any issue.

Dear Hursha
As regards Gratuity is concerned if the amount your company is bound to pay as gratuity is under the Payment of Gratuity Act, then deposit the amount with the Controlling Authority under the Payment of Gratuity Act. Otherwise you may be required to pay interest.
