is it ok to grant casual leave when an employee\'s annual leave has not been utilized? the policy in my office is that casual leave is a privilege and not a right whereas annual leave is a right. employees in my office want to take casual leave when the annual leave has not been utilised. i am in hr here and know that they should utilise annual leave first.

I am at my wits end to understand the difference between a privilege and a right and how they were defined in your leave policy.The objects of casual leave and annual leave are different as per industry norm. While casual leave is ment to meet unforseen circumstances and emergencies which are of short duration, annual leave is meant for longer and planned vacation. Therefore caution shall be exercised by HR that an employee shall not resort to annual leave so frequently as to reduce it to casual leave. Both the leaves can be utilised as per the needs of the employee.

Until and unless you have a leave policy or demarktion of leave it will be difficult to suggest. As mentioned by our friend Mr. Saikumar casual leave is used to meet unforseen circumstances hence it can be 1/2 day to a maximum of 3 days, prior permission of a day is required and in emergencies it can be communicated over phone or can be applied immediately after attending the duty.
The Earned / Privilege is is normally used for a minimum of 4 days and should be with prior intimation & permission ie., a minimum of 15 days advance intimation as per Factories act and is restricted to 3 occassions.
No leave is right of any employee, basing on the exegencies the management have every right to cancel or disapprove the leave.
It is better to have a strctured leave policy, communicated to all the employees and implement.

When you recall a staff from leave, you either pay back those days into his leave account to be utilized at a later date or you monetize the leave period.
This can be calculated at 1.5 of base pay and multiplied by the number of days.
