Hi Members! Please answer a small query I joined newly in a factory before my joining no body in HR department Now I want to know the working hours generally in any factory will follow this because my company working from 9.00 am to 6.00 pm on all 5 days. All Saturdays & Sundays are holiday’s b’coz MNC Company but this is not a policy to work only 5 days in a week If any employee working on Saturday we will pay OT pay for working on Saturday This payment we made for regular as well as Contract employees OT payment we will pay 150% on Saturday Now my management wants to reduce the OT payment in Saturdays for contact employees if it’s possible even regular employees also. My question is in 9.00 to 6.00 working hour’s weather we will count break times also or not. Break times like 15 min tea break ½ hr lunch break 15min tea break In this scenario what is the actual working hours? Those who will work in Saturday we will pay only daily wage for contact employees is it justify. Or other we have to pay OAT payment on Saturday Please guide.............. Its urgent.... According to rules normal working hours per week is 44.75 hours with 8 hours per day.other than that will be o.t and has to be calculated as 200%

i have to include breaks also for calculating daily working hours (lunch/tea breaks) or exculding breaks and give me OT regarding contract employees

Breaks need not be included.It is excluding breaks. OT REMAINS SAME FOR CONTRACT EMPLOYEES ALSO IN NORMAL PRACTICE.

Hi, As per Factories Act 1948, a worker has to work to a maximum of 48 Hrs. exclusive of intervels for rest in a week as per Sec. 51, 55 & 56. Please also refer sec. 52 which says about weekly rest on the 1st day of the week- the 'said day' or any other day which has been substituted. In your case, workers are working only for 7.5 hrs x 5 days where as your employer has the right to ask for work for 8 hrs x 6 days. In this case your employer should not pay OT for saturdays. Manish

can any one submit any proof or reference for the payment of over time wage for the contractual workers please ? asd in our state we are paying the OT wages as the normal wage rate / per day / no of working hours per day basis Pragatika:?:

A normal working hours from 9 am to 6 pm which includes rest time or lunch time is appreciable. Since you are not coming under Factories Act, you can fix your working hours, overtime rate and weekly off. However, in an organisation which has adopted 5 days working, the overtime rate of wages should also be under your control. A normal 48 hours of work per week is not satisfied in your case. Therefore, there is no harm in calling workers to work on saturdays with even single rate of wages since the workers are still getting one whole day of rest on Sunday. However, the problem here is in the absence of a Standing Orders (of your own) and since the employees are already enjoying a facility in the form of 1 1/2 of wages for OT, you cannot take it out. The previlage of 1.5 times wages for OT enjoyed by your workers has now became their right. In this circumstance, it is better to rearrange the schedules and overtime policy fresh in consultation with your workers. Even in the Factories Act, a worker's normal working hours has been fixed at 9 hours and not 8 hours. The Act makes it obligatory to give only one day weekly off. Therefore, your workers are not suppose to ask for OT for their work on saturday. By Contractual employee if you mean those who are employed through a contractor and whose names do not appear in the Muster rolls, then the obligation to pay OT lies on the Contractor and not you. If you mean those who are employees appointed by you under a contract that the period of appointment is for a specific period and whereas payments are made by you only, then they should be treated at par with any regular employees and the rules relating to OT, working hours etc will be directly applicable to them. HI!
Working hours are fine and the lunch and tea break are included in this. These things are a part of official working. As a part, about OT payment on Saturdays are concern. OT is meant only for labour class people. Staff is not included in OT. If one wish to work on Saturdays, he will not be paid any OT. But in a labour class, if a worker is working on Saturdays or Sunday he will be paid OT charges as defined in the company policy.
