I was previously working with a Mattress comp as an Asst Manager, however I resigned with immediate effect due to some personal issues. I have now joined a competitor at a higher position, however my previous company had added a clause that i cant work with a competitor for 2 years & are now threatening to file a law suit against me. what shall i do? I never new about the clause til date & no one in the company knows bout the same.Kindly advise.

I don't think it is legally valid clause. Pl. discuss with a known lawyer and find out. What ever it may be if you are not communicated and accepted then you are not party for that.

Have y signed any bond/undertaking & if Yes than what is damage charges mentioned in the said clause if you joined the competitor?
If the same is their than company may file civil suit against you for the recover the said damage.
