Is there any law on LEAVE for employees in private limited company? Or the company ha s the right to set any "Leave Policy".

Dear HR Gurus,
Apologies for posting up new topic under irrelevant discussion. (As am not able to figure out to post new topic discussion).
Well I have an query on Leave Encashment policies followed by various organisation. In my company; the Mgt does not prefer leave encashment.. Inshort balance leaves are Lapsed (Which is demotivating to employees) As the management says, their is some tax or company is paying tax amount incase they provide leave encashment benefit.. Pl suggest is there anything like this? or the company doesnt want to provide this benefit to its employees..
Incase yes, there are compliances then pl suggest a way where Mgt and employees both are happy!!..

Dear Kavitha,
In every organisation there is a leave encashment policy under which unavailed Casual leaves & earned leaves are encashed in the employees account. No tax penalty will be there on the company, if the company provide leave encashment to its employees.
Unavialed earned leaves will be encashed at a rate = (Basic+DA)/26
Unavailed casual leaves will be encashed at a rate = (Basic+DA)/30
Leave encashment rate can vary from company to company.

Oh Thanks, Sandeep; I have got my answer... BTW our company is Manufacturing based, what would be the right combination of leave categories? Also i assume leave can be accumulated for N number of years, to be encashed either during exit/retirement - Right?

Dear Kavitha,
In our organisation, we follow the following leave combinations per year..........
Casual leave - 10 , Sick leave - 10 , Earned Leave - 18 (1.5 per month )
Accumulation limit for EL - 150 ( If EL exceeds the limit 150 then same will be encashed to the employee account)
Accumulation limit for SL - 60 ( If CL exceeds the limit 60 then same will be encashed to the employee account)
Unavialed CL leaves will be encashed every year end.
So, Leaves can not be accumulated for N no. of years beyond the max. limit.
During Exit / Retirement all unavailed leaves are encashed.
Clear ??????????
