Can employee waiver the notice period
Hi i am raghavendra babu .i have a problem in serving the notice period.according to company policy the notice period is 2 months and i am planning to relieve with in 1 month due to family problems but when i contacted hr he is telling its compulsory to serve the notice period.i hope in every company there is an exception for waiving the notice period like buy out option .i am ready to pay the notice period amount but they are telling u cant. only 1 reason they are giving me is that it is company policy u have to serve 2 months. even i dont have any work in office and there is no need to create backup. so anyone 1 can suggest me how to move forward and get releived soon.
Notice period
Hi friends i am working in a software company from past 2 years. i have initiated my resignation for some reason. if company relive me in the notice period itself is company will give my notice period salary. in my offer letter it is geven as the employment with the company is subject to termination on two months prior notice by either side the company reserves the right to at its sole discretion substitute the notice period by paying you salary in lie of the notice period. some of my collegues are saying that company may change the policy and terminate without giving the notice period salary because of current market situation. is it can happen so.. please suggest and guide how i can defend myself.
Company exit policy
Hi i am working in a it company. i have joined this company in 2011 that time i got the appointment letter in which they have mention 1 month notice period during the probation period. now i have put my resignation. company is not giving me any confirmation letter and they have change there exit policy. as per there new policy they are asking for 2 months of notice period. this policy is return in document and share with in the company. please guide me how i can process. regards deepak
Difference between notice period waiver and notice period buyout
My appointment letter says any shortfall in notice period can be adjusted in lieu of payment however new policy on notice period says notice period cant be waived off.does that mean notice period can not be bought out
Servcie agreement and notice period
Hi could you anyone please advice on the below. i went onsite to serve my cilent for 1 year and came back in this august. as per agreement i have to serve my company for minimum period of 6 months. it is almost 3 months i came back to india and 3 months is the notice period as per company policy. now i am planning to leave this company due to personal things to be settled in my hometown. i am ready to serve 3 months period. my quey is will this notice period added to minimum service period as per agreement? or do i need to serve 6 months minimum and then i have to serve 3 months notice periodtotal 9 months? can it be fine if my notice period overlaps with minimum service period 6 months? below are the points concerned about in the agreement. point 6 says tyo serve minimum 6 months and point 8 says \"c fails to serve the employer for the period specified. in addition to this the employee is also governed by the three months notice period as per company policy.\".
Does notice period hold valid if there is no mutual contract?
Hi my query is simple. my original appointment letter states my notice period as 1 month. however later the organisation changed its company policy and amended the said appointment letter to read as 3 months notice. however the hr department just sent a mail telling all employees that the new notice policy will be binding on all. they never modified any contracts to state the same and didnot take our signatures. my question is what would hold valid in a court of law? a signed appointment letter stating one month notice period or a company policy statement stating the change in notice period to three months?
