Hi All,
Recently, I heard through word of mouth that there has been an amendment in Maternity Benefits Act in terms of the leave period extended to 6 months.
Is this a correct information? I tried to find on some sites, could not get anything relevant.
Please comment..

Dear Ashwini,
There will be not circular received from Labour dept. about amenment in no. of leave. Neither we heard any labour journal.
But recently, the amendment happened in Maternity Bonus. The Bonus amount enhanced from Rs. 250/- to Rs. 1000/-.

Thanks for sending the amendment.
But it is vague "if no pre-natal confinement and post-natal care is provided by the employer free of charge"
Can you elaborate on this please.

Anuraadhaa,
Post natal care is the special care of the newly born after the birth. If an employer is providing any such facility free of cost then he is not liable to pay Maternity Bonus.
Nisha: Earlier this amount was Rs 250 which is now proposed to be revised to Rs 1000/-. Its just a type of allowance given by the employer to the employee in subject to enable her meet the immediate expenses on the newly born child after birth.

Thanks a lot for the explanation.
One more thing, "no pre-natal confinement " would mean?
The word "confinement" is quite misleading coz we can't force a employee to go on leave or take rest. we had case wherein the employee worked till almost the last date of delivery.

Hi Anuradha,
You have misunderstood the meaning of Pre Natal Confinement. It is called confinement for the unborn child as he/she remains confined in the womb of the mother. Pre Natal Confinement Care means all the care before expected delivery and post natal care means care after delivery. Hope everything is clear now.

I read on net about the amendment of maternity benefit act in 2007
Although the act named as MB act 2007, the bill was passed in Feb-March 2008
Does it means women, who delivered after March 2008 can avail the benefits, or before that?
What does means pre natal care? Does it include Doctors appointed for company or money(Gynac charges) provided by company...? or anything else?
If any women applies/ delivered baby during period after putting the bill in houses of parliament (i.e. MAy 2007) & before it got passed; can she get the benefit of amendment?
If the woman is physically unable to reach at the work on time(due to child's requirement of feeding) but completes the work hours, can she take protection of the act?
How she can take benefit of nursing breaks if there is no creche in office & her home is far away from the work place? Can she ask for concession in IN & OUT timings?
