Lta claim after full & final settlement
Hi i left my job in june 2009 and received full and final settlement from my company after a month. at the time of leaving i didn t submit my lta claim. now i want to claim lta before form 16 is generated by my company but the finance guy in my company is saying that now he can t take my lta claim and i should have submited it in june last year. he s is saying that since now i m not on payroll of company he can t access my account. i want to know is it really not possible to claim after you have received full & final settlement or he is just avoiding his work. since i m not employed anywhere i really want to claim my lta with my previous company. kindly clear my doubt. thanks deepika

Please tell me...how to calculate full n final settlement.... i work fr a company for 11 months.... does deduction made during my probation period will also be calculated while making my final settlement??? the company didn t gave me any confirmation inspiteof commitment of giving it after the probation... there were deduction for my gratia lta & gratuity mediclaim... how m i supposed to calculate my claim?

This excel is for understanding the gratuity calculation which is a tentative calculation to find the amount for gratuity when person left from the organisation. or we say at the time of full and final settlement. formula : last drawn salary/2615no of yrs service. rules : 1 which consist of minimum 5 yrs service as per gratuity act 1972. and if person complete more than 6 month then its consists 1 year. 2 but the person who is minimum 4 yrs & 8 month service is consider as "0" zero years of gratuity service. 3 and if his is work for 4 yrs & 8 month and more but less than 5 yrs then also he is consider as 5 yrs of services for gratuity is applicable.
Non payment of gratuity by previous employer
Dear sir i have worked in an organisation private for more than 9 years. i started from very junior position and promoted up to very senior position in that organisation over 9 years. recently i have resigned from that organisation by giving and serving a notice period of 30 days as mentioned in my appointment letter. on the last day my employer gave me an outstanding due and final settlement letter mentioning my salary for 9 days and accrued leave amounting rs. 75000. the letter also says that after signing and receiving this amount i cannot claim for any esi pf and gratuity. i had to sign over it as i wanted the experience letter from him which he gave only after signing over it. but finally he has not given me even the said amount 75000 of salary for 9 days and accrued leave. the employer is now asking about my new employment details which i don t want to share as it was nowhere mentioned in appointment or final settlement letter. now my question is that 1 can i claim for 75000 without disclosing the new employment details? 2 can i also claim for gratuity amount as i have already signed the final settlement letter? thanks for help

Sir i am a logistic executive who had served in a company for 5 years & resigned from service on 31/3/2011 after serving a notice period of 1 month .i have been issued a relieving letter on the same day but till now the company has not cleared my final settlement when i check with hr i get an information that finance manager is holding your settlement since there is some discrepancies in stock. i want a solution to this problem 1. can company hold my settlement for difference in stocks when the final relieving letter issued. 2.what future course of action to be taken to claim the settlement. please help me. regards lakhs 826

Neeraj kaushal hi all i have been going through a problem and i am sure that you all would be able to guide me on the further course of action. to begin with i have more than25 years of experience in manufacturing field and my last job was with an pvt. ltd. company for a period of 4 years and 8 months. after 5 months they have not made my final settlement and not calculated gratuity in that. can i claim my gratuity now through legal process even though i have signed the f&f papers? regards neeraj
