Gratuity and overtime claim
Hello i was working in a partnership firm from last 9years and 10 months. my employer was entering my salary as basichraccata in the salary sheet. i claimed gratuity on my total gross salary but he is counting on basic salary only. pls tell if my claim is correct or not. another thing is that our duty time is more than 9 hours and our employers never paid any overtime to any one. i have heard that an employee can claim at least his last 3 year\'s overtime. pls tell if it is correct.

Our company has taken group gratuity policy from lic and paying gratuity on gross salary. the premium was also calculated and paid to lic on gross salary. but while making full & final settlement the gratuity was calculated and paid on basic salary. how can we claim the balance gratuity amount and who is the competent authority in such cases.

Hello hr professionals i would like to implement gratuity benefits for our employees as per the payment of gratuity acts 1972. as per the act gratuity formula is no of years of services last drawn basicda15/26. i have some doubts regarding the same how we will consider basic for calculation in case of any employee who has basic salary e.g 45000 basic da but his basic is restricted to pf as 15000? which basic needs to be considered while calculating his gratuity. please explain.

Hi to members pl. clarify my following problem: iam working in a co. at gurgaon from 1995 to date. i am already 65 age. p.f. is deducted from my salary for all these time. iam told the pension will not be given if one attain age of 58. then how can i claim the amount that have already deducted from age 58 to 65 that accrued in p.f office & to whom i can claim from ? co. or p.f office? how much i can get as pension ? is it possible to get it in lumpsum amount ? for calculation of gratuity i have salary structure basic hra conveyance will it be basic hra or basic only or total of all ? how it is it calculated ? 15 days salary total ? or monthly salary x no years in service divided by 26 ? pl. offer your valuable opinion/ solution . thanking you s.kannan
Retirement benefits - gratuity and leave benefits only from his basic salary was added
A peon worked in a company for 40 years.his basic salary increased yearly and at the time of retirement basic salary was 6810.00.he was not given d.a from past 20 years.his retirement benefits was contained leave salarypf and gratuity.he got only 3 lakhs rupees as retirement benefits.he want to know whether he is eligible for getting any other retirement allowance? he was paid hra rs.4090/as per his last pay slip 2015 march. but he had own house and not claimed for rent. but hra paid by company. he is not capable to understand the divisions and different heads in his pay slip to split his salary. for gratuity and leave benefits only his basic salary was added. whether he has any right to claim for more benefits? he did not know the pension rule of his company.since last grade he was isolated. whether any remedy available to him? thank you very much
