Dear member,
What act/rule speak about non-applicability of ESI act, how far a factory should be from local office or esi hospital or a dispensary ? what is minimum distance or what exact rule say about exemption of ESI act.

It is not as per the distance. It’s as per the no. of units available in the area. You need to check with the Local ESI Authoroties/Regional Office of that state. Regards, Kamesh Kumar Khatana

Dear Naresh,

Please submit a letter to your nearest ESI Regional Office/Sub-Regional Office mentioning the address of the establishment mentioning Taluk also, so that they can confirm whether it is an implemented area or not. Also you have to follow the same procedure every year during April, since the State Govt may decide to implement the scheme in an area where it was not implemented previously in the month of April every year.
