Closure of industrial undertaking
Dear members i have a confusion in interpreting chapter va and vb of the id act section 25ff of chapter va is narrated below 25ff. compensation to workmen in case of transfer of undertakings where the ownership or management of an undertaking is transferred whether by agreement or by operation of law from the employer in relation to that undertaking to a new employer every workman who has been in continuous service for not less than one year in that undertaking immediately before such transfer shall be entitled to notice and compensation in accordance with the provisions of section 25f as if the workman had been retrenched section 25s in chapter vb 25s. certain provisions of chapter va to apply to an industrial establishment to which this chapter applies the provisions of sections 25b 25d 25ff 25g 25h and 25j in chapter va shall so far as may be apply also in relation to an industrial establishment to which the provisions of this chapter apply. my question is whether we can transfer the ownership of the undetaking which employ around 150 workmen without seeking the permission of the approptiate goverment since as per the act sec 25ff provisions can be applied for chapter vb companies also. kindly share your view on the above
Section vb applicability
I have 2 units under the common name "x". they are engineering industry manufacturing automotive components. one is situated in bangalore and the second one in tumkur. my bangalore unit has 80 emloyees out of which 50 are workmen and my tumkur unit has 96 employees with 88 are workmen. i have transferred 12 workmen from tumkur to blore in nov 2012. can i retrench workmen from tumkur plant on the basis of lastcome first go without seeking govt permisiion. for the purpose of applicability of chapter vb of id act do we consider each factory seperately or both are clubbed. if i club both then the workmen strength becomes 138 in whcih case govt permission becomes necessary ?? coan anyone please clarify. thanks.

I would like to know which clause of id act 1947 25 f or 25 n is applicable is case of chrome mines in orissa and why. we are mining contractors and one of our contract is going to closed so we have retrench the workers
Purpose & significance of employee id cards
Hi all seniors i ve a query here. hope any of the seniors would kindly clarify my below query. "we had recently supplied the id cards for our employees. the employees attended the office wearing id cards hardly for a few days no employee showed interest in wearing the id cards and now they have completely stopped using the id cards that was supplied to them. so i want to circulate a memo to all employees informing that wearing of id cards is mandatory and every employee shall attend the office wearing the id card. my question is.... 1 can i advise our employees that wearing of id cards is really compulsary and that it has been made mandatory? 2 what is the exact & of providing id cards to the employees?"" senior hr peers kindly clarify me at the earliest since i ve to circulate the memo very soon. thanks & best regrds

Lay off procedure to an industrial establishment employing more than 50 and less than 100 workmen.
Dear members in id act section 25a of chapter va is applicability of sections 25c to 25e. which talks about layoff and also it tells that sec 25a is applicable to industrial establishment employing less than 50 workmen. in a nutshell sec 25a tells the procedure of lay off to be followed by an industrial establishment employing less than 50 workmen. chapter vb is applicable to industrial establishments in which more than 100 workmen are employed. now my question is what procedure is to be followed during lay off by an industrial establishment employing more than 50 and less than 100 workmen. pls clarify. thanks.
