Dear all,
i have need a little query as per act:-
when we appoint an employee as per minimum wages and pay him PF now minimum wages increased but PF limit is same.as per pf limit that is exempted and we can stop PF contribution.now PF inspector says if you enroll any employee in PF than you have to pay PF till Resign.
IN ABOVE MATTER IF YOU HAVE ANY NOTE,NOTIFICATION,OR ANY LINK PLEASE REPLY POST OR MAIL AT

Dear Mr.Kumar
Refer to your query on the above subject, Pl go through Sec 43 describes that at the time of inception, whose wages are exceeds Rs.6,500/- per month and also an employee covered under PF Trust as framed by the employer under the guidelines of RPFO/CPFO U/s 17 (1) of the EPF Act -1952.

Whatever your PF Enforcement Officer has said are right. An employee once covered by the Scheme will continue to be covered irrespective of any hike in his salary. Therefore, you can not stop his contribution just on the ground that his salary has crossed Rs 6500.

yes, very correct, in case anyone is a member under EPF Scheme, he will remain the member but the PF deuction will restrict to maximum limit which is at present is rs.6500/- regards nigam

Hi, Above said is perfect. If any employee’s PF deduction is started, you cannot stop the deduction till his employment with u. Agree with the inspector. Regard,

I agree with the above views. Section 12 of the Act be seen-Employer not to reduce wages,etc. Similarly, Para 29 of the EPF Scheme onward be reffered dealing with Contributions. In fact, statutorily, Minimum Wages has nothing to do with the EPF & MP Act 1952, but under the Minimum Wages Act, Employer is bound to pay minimum wages. Under the EPF aCT, PF IS TO BE DEDUCTED ON THE BASIC WAGES PLUS DEARNESS ALLOWANCE and Retaining allowance ,if any, but Employer is not bound to deduct PF contributions above 6500 untill and unless mutually agreed upon. In case PF is being deducted at higher wages, it can not be reduced in normal cirumstances.
