Is it possible for an employer to extend probation without informing the employee. there is no probation extension clause mentioned in the employment contract letter. if the company extended the probation without informing employee and later terminated him for performance issues is it possible to move legally. below is the clause on probation. you shall serve a probation period of 3 months during which either party may give 7 working days notice of termination and your entitlement to all employment benefits will be at the discretion of the company.

I am facing an issue where the management wants to terminate an employee during probation. the employee joined in april and we have a 3 months probation period at the end of 3 months his probation was extended by 2 months as his performance was subpar. now in august he is still performing poorly in spite of getting detailed feedback and support from the managers. below is mentioned in the contract "probation there would be a 3months probation period with effect from the commencement date. the employer may extend the probationary period for up to maximum 3 more months with the confirmation from the employee and employer." termination of employment this employment may be terminated by the employee or by the company in writing giving the other party 2 two month s notice period." as per my understanding the employee will need to serve a 2 months notice period from the date of termination. please provide your suggestions if this is the only legal way out.

Termination of employee due to poor performance - but i do not want that to reflect on their career
So i have a very new company with less than 5 employees. one of our senior employees helped me make the job offer letter. after opening the company for the first time i have to terminate someone due to very poor performance. but i do not want that to reflect on their career hence i told them that due to covid i have to let them go. will write the same on relieving letter too. now according to me the termination clause in the offer letter says minimum notice so i gave them 30 days salary without any work. this employee is threatening me to provide a 60day salary due to the last sentence in the probation period. what is the correct thing to do here? probationary period: as per organization policy the probation period applicable to you shall be six 6 months. during probation the company reserves the right to terminate the employment without any notice if your performance is not deemed satisfactory. after the probation period the notice period will be two months. termination: company may terminate your employment at any time for cause. after the end of your probationary period company may terminate your employment without cause at any time by providing you with the minimum notice or pay in lieu of such notice and any severance pay required by the theneffective employment standards act.
