Availing leave is the prime privilege for the employee..if the employee availing leave during notice period..it should be approved by the prior authority..if the leave is approved..then there is no case on it..

No During the Notice period No one can take leave But you have to pay all leave benifit to that in his/her F and F

according to the company you are not aloud to avail leaves in your notice period but some companies provides the leave en cash policy,by the use of this policy you can take some amount against your leaves.

ok then what is the Last Working Day of that employee? if that is last december 2011 Then you have to pay the leaves to him/her because that is mandatory

Availing leave is privilege of the employee and labor laws are behind him. In case of notice period it is the sole discretion of the management of to consider leave days in notice period or may be extended his notice period for such leave days.
Normally in practice we consider his genuine leave days.
